Representatives of a cannabis dispensary testified before the Feb. 8 Union Board of Adjustment seeking approval to open a cannabis dispensary on Route 22.
Attorney Joseph Paparo of Porzio, Bromberg and Newman, said the business, Botera Union, LLC, has plans to open a cannabis dispensary in a vacant retail space in an existing shopping center at 2290 Route 22 East, and is seeking a variance regarding the required setback from a residential zone and a variance for required parking.
There are currently seven businesses going through the state application process to open in West Orange. However, the ordinance, as it is currently written, has been called into question, as federal guidelines state that cannabis businesses should be more than 1,000 feet away from these areas, not the 200-foot distance for which the businesses were approved according to the West Orange ordinance.
The Red Bank Borough Council will hold a special meeting Monday to review and discuss its ordinance that regulates certain requirements for cannabis businesses to operate in the borough.
The meeting is at 6:30 p.m. in Council Chambers. It is also a hybrid meeting so residents can follow it on Zoom.
The discussion may include, but is not limited to, a review of borough ordinance 2021-17, which amended the cannabis regulations for the borough, according to the notice.
The Red Bank council will hold a hybrid (online and in-person), special meeting on Monday, February 20, 6:30pm, at Borough Hall, 90 Monmouth Street.
This session is in response to the February 8 council meeting that focused on current Federal law that prohibits the sale of marijuana within 1,000 feet of a school, playground or public housing facility.
For this week’s meeting, the council was being asked to support applications by Green Flamingo Dispensary LLC to operate a retail cannabis business at 447 Central Ave. It has pledged to provide $7,500 to Miracle Temple Pentecostal Church for charitable endeavors.
A proposed marijuana business in Montclair took a leap forward on Monday when the planning board granted it a conditional use permit as a cannabis cultivator.

At issue is the zoning ordinance that disallows a cannabis business from operating within 1,000 feet of a public park.
Marchetti, reading from a prepared statement said, “We are here asking for a consideration on the zoning for a proposed (cannabis) dispensary. We did apply to use this location as a dispensary but was denied by zoning. The reason for this is there is a playground in Marine Park within 1,000 feet.
Di Croce, whose long-held vision has been to make Shamong the “pot growing capital of New Jersey,” both to increase ratables and job opportunities, as well as lower or eliminate altogether local property taxes, last served as township mayor in 2020, when he worked to help establish the Cannabis Subcommittee in December of that year, which has since helped form the current local zoning regulations for cannabis, and recommended to the governing body where cannabis operations should be a permitted land use.
A lawsuit filed last week in Passaic County Superior Court accuses West Milford officials of tipping the scales in the state's highly competitive cannabis retail licensing process.
West Milford officials are blocking the owner of Big Smoke, a Route 23 smoke shop, from pursuing a New Jersey cannabis retailer license in favor of another applicant, also named in the suit, seeking to sell marijuana in the same commercial complex, the lawsuit stated.
