Will There Be a Craft Marijuana Industry in New Jersey?
With adult-use marijuana being recently legalized in New Jersey and New York, the same industry idea that was kicked around to encourage microbreweries to open has been incorporated into the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMMA) for cannabis “microbusinesses” to open.
So, what is a cannabis “microbusiness”?
The Borough Council wishes to solicit input from residents regarding the crafting of a municipal ordinance in accordance with the guidelines set forth by the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act and will hold a special meeting on Tuesday, May 11th @ 6:00 p.m. The meeting call-in information appears at the end of this message.
Now that New Jersey has legalized marijuana use and possession for adults 21 years and older, South Jersey municipalities have begun adopting their own rules to address use and sale. Under the N.J. Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act towns have until Aug. 21 - 180 days from the adoption of the state law - to create any local enforcement structure. Towns that do not act by then will be governed by the state's law.
Here's how communities are responding in South Jersey:
On March 10, 2021, less than three weeks after New Jersey Governor Phil Murphy signed legislation legalizing recreational marijuana and establishing employee protections for off duty marijuana use, a State lawmaker has introduced a bill (NJ S 3525) to amend the employment related provisions of the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (“NJCREAMMA”) to address concerns that employers will not be able to control marijuana use, or the effects of marijuana use, in the workplace for safety sensitive positions.
