A Jersey City cannabis shop is suing a competitor and the city’s planning board, saying the board illegally approved the other shop to open within 600 feet of its location.
The Cannabis Place 420′s 10-page lawsuit claims the board made its decision to approve Kushmart after the city’s supervising planner, Matt Ward, incorrectly stated “there were no retailers” within 600 feet of The Cannabis Place 420 door at 1544 Kennedy Blvd., near Custer Avenue, on the southern end of the city.
Kushmart’s front door is 338 feet away, roughly block north at 1521 Kennedy Blvd., on the opposite side of the street. Neither has opened yet.
A Jersey City ordinance approved in 2021 says the main entrances of cannabis businesses with a retailer license must be at least 600 feet apart.
